General Terms and Conditions

Auriteq - Eloy Caudet-Roca Garcia, Albert-Steiner-Str. 21, 52134 Herzogenrath, Germany. Last updated: October 2026.

§ 1 Scope and contracting party

  1. These General Terms and Conditions ("Terms") apply to all contracts concluded between Auriteq - Eloy Caudet-Roca Garcia, Albert-Steiner-Str. 21, 52134 Herzogenrath, Germany ("Auriteq", "we", "us") and a customer through the online shop at auriteq.com.
  2. These Terms are written for consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). Business customers are welcome to contact us at info@auriteq.com for an individual offer.
  3. Deviating terms of the customer do not apply unless we have expressly agreed to them in writing.
  4. The version of these Terms valid at the time of the order applies.

§ 2 Conclusion of contract

  1. The presentation of products in our online shop is not a binding offer. It is an invitation to the customer to place an order.
  2. You can place products in the shopping cart without obligation and change your selection at any time before sending the order. All entries can be reviewed and corrected on the order overview page using the usual browser and keyboard functions before the order is placed.
  3. By clicking the order button labelled "Buy now" (or the equivalent wording in your language) you submit a binding offer to purchase the goods in the cart. The order can only be placed after you have accepted these Terms by ticking the corresponding box.
  4. We will confirm receipt of your order by email immediately after it is placed. This confirmation of receipt is not yet an acceptance of your offer unless it expressly says so.
  5. A contract is concluded when we accept your offer. We accept it either by sending a separate order confirmation, by dispatching the goods, or by requesting or collecting payment through the payment provider you selected, whichever happens first. If we do not accept your offer within five days, you are no longer bound by it and any payment already made will be refunded without delay.
  6. The contract text is stored by us. The order data and these Terms are sent to you by email with the confirmation of receipt. Past orders can be viewed in your customer account if you created one. The contract language is the language in which you placed the order in the shop.

§ 3 Prices, currencies and shipping costs

  1. Prices are shown in the currency assigned to your delivery country in the shop. You can change the country and currency using the selector in the shop. The price shown at the time of the order, in the currency shown there, is the price you pay; it is stated again in the order confirmation.
  2. For deliveries within the European Union, all prices are final prices and include the statutory value added tax applicable to the delivery country. For deliveries to other countries, the checkout shows whether the price includes or excludes taxes and duties before you place the order.
  3. Shipping costs depend on the delivery country. For some countries shipping is free; for others a shipping charge applies. The applicable shipping cost is shown on the product page via the "shipping" link and in the checkout before you place the order, and is itemised in the order confirmation.
  4. For deliveries to countries outside the European Union, one of the following applies, as shown in the checkout:
    • Duties and taxes included (DDP): for the countries so marked, import duties and local import taxes are already included in the total shown at checkout. You will not be asked to pay anything further on delivery.
    • Duties and taxes not included (DAP): for all other countries, import duties, customs clearance fees and local import taxes may be charged by the authorities or the carrier in the destination country. These charges are not included in the price or the shipping costs and are payable by you. The amount depends on the destination country and cannot be determined by us in advance.

§ 4 Payment

  1. We offer the payment methods displayed in the checkout. Currently these are credit and debit card, Apple Pay and Google Pay (processed via Shopify Payments), PayPal and Klarna. Not every payment method is available in every country.
  2. The purchase price is due on conclusion of the contract. With card payments, Apple Pay, Google Pay and PayPal, the amount is charged when the order is placed or when we accept the order. With Klarna, the terms of the Klarna product you select apply; Klarna's own terms and privacy notice are shown to you during checkout.
  3. If payment fails or is reversed for reasons you are responsible for, we may withdraw from the contract after an unsuccessful reminder.

§ 5 Delivery and shipping

  1. We ship to the countries listed in the checkout. If your country is not listed, please contact us before ordering.
  2. Delivery is made to the delivery address you provide. Delivery times are shown on the product page and in the checkout and are calculated from the day we accept the order and, for prepayment methods, from receipt of payment. If a product is temporarily unavailable, we will inform you immediately and tell you the expected delivery time; you may withdraw from the contract if the delay is unreasonable for you.
  3. Should a product be unavailable through no fault of ours (for example because a supplier fails to deliver to us), we will inform you without delay and refund any payment already made. We will not deliver a substitute product without your agreement.
  4. Partial deliveries are made only if we have agreed them with you. We will not charge additional shipping costs for partial deliveries we initiate.
  5. The risk of accidental loss or deterioration of the goods passes to you when the goods are handed over to you or to a person you have named to receive them. This also applies if you have asked us to use a specific carrier.
  6. If the packaging shows visible transport damage on delivery, you are not obliged to accept the parcel. It helps us to process a transport damage claim with the carrier if you note the damage with the carrier and inform us at info@auriteq.com. Not doing so has no effect on your statutory rights.

§ 6 Retention of title

The goods remain our property until the purchase price has been paid in full.

§ 7 Right of withdrawal

  1. As a consumer you have a statutory right to withdraw from the contract within fourteen days without giving reasons. The conditions, the consequences and the model withdrawal form are set out in our Withdrawal Policy, which is linked in the footer of every page and sent to you with the order confirmation.
  2. You can also exercise the right of withdrawal online using the withdrawal function on our website ("Withdraw from contract" button).
  3. In addition to the statutory right of withdrawal, we offer a voluntary 30-day return guarantee. The conditions are set out in the Withdrawal Policy. The voluntary guarantee does not restrict your statutory rights in any way.

§ 8 Warranty for defects (statutory rights)

  1. If the goods are defective, you have the statutory rights under §§ 434 et seq. BGB. For consumers, claims for defects become time-barred two years after delivery of the goods.
  2. If a defect is remedied by repair, the limitation period for claims relating to the repaired goods is extended by twelve months in accordance with the statutory provisions. When a defect occurs, you may choose between repair and replacement, unless the option you choose is impossible or involves disproportionate costs for us compared with the other option.
  3. The Auriteq Flow is a product with digital elements: it requires the Auriteq desktop app and firmware to function as described. For the period you can reasonably expect, we will provide the updates needed to keep the device in conformity with the contract, including security updates, and inform you about them in the app or by email. If you do not install an update we have provided within a reasonable time, we are not responsible for a defect that results solely from the missing update, provided we informed you about the update and the consequences of not installing it.
  4. Any manufacturer's guarantee (Garantie) we may offer for a specific product is described on the product page and in the guarantee terms provided with it. Such a guarantee applies in addition to, and does not limit, your statutory warranty rights.
  5. Please report defects to info@auriteq.com. We will tell you how to send the product back; the cost of returning a defective product within the warranty is borne by us.

§ 9 Liability

  1. We are liable without limitation for damages resulting from injury to life, body or health, for damages caused intentionally or by gross negligence, in case of fraudulent concealment of a defect, where we have assumed a guarantee, and under the German Product Liability Act (Produkthaftungsgesetz).
  2. For damages caused by slight negligence we are liable only if an essential contractual obligation is breached. Essential contractual obligations are those whose fulfilment is necessary to achieve the purpose of the contract and on whose fulfilment you may regularly rely. In this case our liability is limited to the damage that was foreseeable at the time of the contract and typical for this kind of contract.
  3. Any further liability is excluded. This limitation also applies to the personal liability of our employees, representatives and agents.
  4. The limitations in paragraphs 2 and 3 do not apply where mandatory law provides otherwise.

§ 10 Software and firmware

  1. The Auriteq desktop app, the device firmware and any plug-ins we provide (such as the Auriteq LUFS Meter) are licensed, not sold. By installing them you receive a non-exclusive, non-transferable right to use them with your Auriteq device for private purposes and, where the software is offered for this, for professional music production. Any separate licence terms displayed when the software is installed apply in addition.
  2. You may not distribute, sublicense or sell the software. Rights that cannot be excluded by law, in particular those under §§ 69d and 69e of the German Copyright Act (decompilation for interoperability, backup copies), remain unaffected.
  3. Trademarks, product names and content on auriteq.com belong to us or our licensors. Names of third-party products (for example DAW names) are trademarks of their respective owners and are used only to describe compatibility.

§ 11 Disposal of electrical equipment and batteries

  1. Electrical equipment must not be disposed of with household waste. The crossed-out wheeled bin symbol on the product indicates that it must be collected separately. You can return old electrical equipment free of charge to public collection points or, if required by law, to distributors.
  2. Our WEEE registration number is DE 40736563.
  3. Please delete any personal data stored on a device before disposing of it.

§ 12 Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG). We will nonetheless try to resolve any disagreement directly with you; please contact us at info@auriteq.com.

§ 13 Applicable law and final provisions

  1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
  2. If you are a consumer with your habitual residence in another country, this choice of law does not deprive you of the protection of mandatory provisions of the law of that country.
  3. Should any provision of these Terms be or become invalid, the validity of the remaining provisions is not affected. The statutory provisions apply in place of the invalid provision.
